Volunteer Release and Waiver of Liability Form.

This Release and Waiver of Liability (the “Release”) executed on the date below by the undersigned (“Volunteer”) hereby releases WE AROSE COOPERATIVE LLC, a benefit limited liability company organized and existing under the laws of the State of Iowa, and each of its directors, officers, employees, assigns, and agents (“WE AROSE CO-OP”), from liability related to or concerning the performance of volunteer services. The Volunteer desires performing volunteer services for the WE AROSE CO-OP by engaging in any lawful activities related to serving as a volunteer.

The Volunteer fully understands that the scope of its relationship with WE AROSE CO-OP is limited to the voluntary performance of volunteer services and that no compensation is expected in return for performance of volunteer services by the Volunteer.

Waiver and Release: The Volunteer hereby releases and forever discharges and agrees to hold harmless WE AROSE CO-OP and its successors or assigns from any and all liability, claims, and demands of whatever kind, either in law or in equity, which arise or may hereafter arise from the performance of volunteer services provided for WE AROSE CO-OP Volunteer understands and acknowledges that this Release hereby discharges WE AROSE CO-OP from any liability or claim that may arise against WE AROSE CO-OP with respect to bodily injury, personal injury, illness, death, or property damage that may result from the performance of volunteer services for WE AROSE CO-OP or occur during performance of volunteer services.

No Benefit: Furthermore, Volunteer understands that WE AROSE CO-OP does not assume any responsibility for or obligation to provide financial or other assistance, including but not limited to medical, health, or disability benefits or insurance. Volunteer expressly waives any such claims for compensation or liability on the part of WE AROSE CO-OP beyond what may be offered freely by WE AROSE CO-OP in the event of injury or medical expenses incurred by me. Volunteer is solely responsible for his/her own insurance coverage in the event of personal injury or illness as a result of volunteer services.

Medical Treatment: Volunteer hereby releases and forever discharges WE AROSE CO-OP from any claim whatsoever which arises or may hereafter arise on account of any first-aid treatment or other medical services rendered in connection with an emergency during the performance of volunteer services for WE AROSE CO-OP.

Assumption of Risk: Volunteer understands that the services I provide to WE AROSE CO-OP may include activities that may be hazardous including, but not limited to lifting heavy objects and involving inherently dangerous activities. Volunteer hereby expressly assumes all risk of injury or harm from these activities and releases WE AROSE CO-OP from all liability.

Photographic Release: Notwithstanding the Publicity Release Form, Volunteer expressly grants to WE AROSE CO-OP the right, title, and interests in any and all photographs, images, video, or audio recordings of volunteer or volunteer’s likeness or voice made by WE AROSE CO-OP in connection with the performance of volunteer services for WE AROSE CO-OP.

Non-Employment: Volunteer shall not make any representations on behalf of WE AROSE CO-OP, nor enter into any agreement on behalf of WE AROSE CO-OP This release shall not be construed to create a partnership, contract for employment, or an agency relationship. WE AROSE CO-OP shall not provide any benefits traditionally associated with employment.

No Criminal Convictions constituting a Sexual Offense or Hate Crime: The Volunteer hereby warrants and represents that it has no criminal convictions related to extreme violence, sexual offense, hate crimes, or drugs.

Other: Volunteer represents it is in good health and suffers no physical impairment that would or should prevent my participation in Volunteer Activities. Volunteer expressly agrees that this release shall be interpreted as broad and inclusive as permitted by the laws of the State of Iowa. This release shall be governed by and interpreted in accordance with the laws of the State of Iowa. In the event that any clause or provision of this release is deemed invalid, the enforceability of the remaining provisions of this release shall not be affected.

By signing below, I express my understanding and intent to enter into this Release and Waiver of Liability willingly and voluntarily. The undersigned hereby warrants its legal majority age, sound mind, and voluntarily signing this form as consideration for its participation in the Volunteer Activities.
